The petitioner, already in custody, seeks bail in connection with Harsidhi P.S. case No. 54 of 2018, for the offences registered under Section 379 and 411 of the Indian Penal Code.
The FIR is against unknown, but during course of investigation one Sonu Kumar and the petitioner was apprehended and a motorcycle was found in possession of them, as both were going on the said motorcycle. Learned counsel for the petitioner submits that the motorcycle was driven by Sonu Kumar not by this petitioner and this motorcycle was given by Raj Kumar Sahni as disclosed by Sonu Kumar.

No.48875 of 2018(2) dt.09-08-2018 2/2 Having considered the aforesaid facts and circumstances, in particular, the recovery of stolen motorcycle was from the joint possession of the petitioner and one Sonu Kumar and petitioner having criminal antecedent of theft. Accordingly, the prayer for bail of the petitioner is rejected. However, trial court is directed to expedite the trial, as it is submitted that charge-sheet has been filed, if trial does not get concluded in six months, petitioner may renew his prayer of bail.
