Mr.Anish Chandra ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-07-2019 The petitioner apprehends his arrest in connection with Belchhi P.S.Case No. 29 of 2018 registered under Section 304B/34 of the Indian Penal Code.

Allegation against the petitioner is that petitioner along with other accused persons used to harass the daughter of the informant for demand of dowry. It has further been alleged that all accused persons killed his daughter for non-fulfillment of the demand.

Mr. Deepak Kumar Sinha, learned counsel for the petitioner submits that petitioner is father-in-law of the deceased and allegation made against him is general and omnibus. He further submits that Dewar namely Ravindra Kumar @ Ravindra Bind and grandmother-in-law namely Sri Devi @ Manti Devi of the deceased have been granted anticipatory bail by the co-ordinate Benches of this Court vide Cr.Misc. No.

Patna High Court CR. MISC. No.20179 of 2019(4) dt.26-07-2019 2/2 18384 of 2019 and Cr. Misc. No. 68237 of 2018 respectively and there is no specific allegation of assault against the petitioner to the deceased and cause of death of the deceased, as per post-mortem report, is asphyxia due to hanging. After having heard learned counsel for the parties and taking into consideration the fact that there is no specific allegation against the petitioner and he is father-in-law of the deceased and similarly situated co-accused persons have been granted bail by this Court, as such I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned SDJM, Barh, Patna in connection with Belchhi P.S.Case No. 29 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
