Patna High Court CWJC No.19227 of 2016 dt.23-11-2017 2/3 serving the copies of the same on learned counsel representing the University and other respondents. Except for the State of Bihar, no counter affidavit has been filed on behalf of the other respondents.
2. In view of the relief, which the petitioner has sought in the background of the facts asserted in the present writ application, this application is being disposed of by the present order.
3. It is the case of the petitioner that it is a private unaided Jain religious minority Institution, imparting Bachelor of Education course (B.Ed.) and is situated in the district of Nalanda. A direction is being sought to the respondents, more particularly respondent Nos. 2 and 3 to issue 'No Objection Certificate' (in short 'NOC') to the petitioner, as required under Regulation 15 (1) and Regulation 15 (3) of the National Council for Teacher Education (Recognition, Norms & Procedure) Regulations, 2014, for additional intake of 100 students, comprising of two basic units of 50 students each for B.Ed. course of two years duration for the academic session 2016-18. It is the case of the petitioner that the institution entitled for such permission as it fulfills the necessary requirements and had applied online before National Council for Teacher Education on 27.06.2016, but his case for recognition is not being considered for want of 'NOC'.

4. In view of the above, I, hereby, direct respondent Nos. 2 and 3 to ensure that a decision on the question of grant of 'NOC', for the purpose as indicated above, is positively taken within a period of one month, if not already taken, from the date of receipt/production of a copy of this order and such decision is communicated to the petitioner-institution immediately thereafter.
