In this case, the petitioner is seeking anticipatory bail in connection with Barahiya P.S. Case No. 299 of 2018 registered for offence punishable under sections 4/40 of the Minor Minerals Concession Rules, 1972 and 03/08 Bihar Illegal Mining, Transportation and Deposition and section 15 of Environment (Protection) Act.
The police was suspicious that the petitioner was carrying the illegal stone chips. It was a case of over loading. The vehicle was intercepted, but the driver fled away from there. It has been recorded that earlier also the vehicle was seized, but the same was taken away very cunningly.
The learned counsel for the petitioner submits that the petitioner has wrongly been implicated in the present case with false
Patna High Court CR. MISC. No.16811 of 2019(2) dt.27-03-2019 2/2 and frivolous allegation. In the petition a road permit has been attached, including all the documents relating to the said vehicle and also attached the challan of the concerned Department. Looking to the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he, in the event of arrest or surrender before the court below within six weeks from today, is directed to be enlarged on anticipatory bail, but after verification of the record attached by the petitioner in this petition, on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Barahiya P.S. Case No. 299 of 2018 , subject to the conditions as laid down under section 438 Cr.
PC and also subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
