Petitioner is seeking anticipatory bail in connection with Dariyapur P.S. Case No. 426 of 2018 registered for the offences punishable under Sections 30, 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the name of the petitioner has transpired in the statement of the apprehended accused. It is submitted that save and except that there is no other material to connect this petitioner with the present case. It is further submitted that the recovery of illicit liquor has been made from a truck which was standing besides the house of one Sailesh Kumar. So far as this petitioner is concerned, it is submitted that he has no concern with the said

Considering the facts and circumstances of the case, the submission that the name of the petitioner has transpired in the confessional statement of the co-accused and that the petitioner has got no criminal antecedent, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned 6th A.D.J., Saran in connection with Dariyapur P.S. Case No. 426 of 2018, subject to the condition prescribed under Section 438(2) of the Cr.P.C.
