JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-10-2024 Though the present writ petition has been filed for quashing the order dated 24.06.2021 passed by the Divisional Commissioner, Magadh Division, Gaya in Arms Appeal No. 219 of 2018, whereby and whereunder the order passed by the District Magistrate, Jehanabad dated 10.09.2016, rejecting the application of the petitioner for grant of arms license, has been upheld, however, at the outset, the learned counsel for the respondent-State has pointed out that the petitioner is an

Patna High Court CWJC No.5292 of 2022(5) dt.22-10-2024 2/2 accused of Miapur massacre case pertaining to Uphara Police Station, District-Aurangabad and the State has preferred a Special Leave Petition before the Hon'ble Supreme Court of India vide SLP (Criminal) No. 010442-010452 of 2013, which has been admitted and the Special Leave Petitions have been converted into Criminal Appeal Nos. 002130-002140 of 2013. 2.

In view of the aforesaid, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to renew his prayer for grant of arms license and/or assail the aforesaid orders dated 10.09.2016 and 24.06.2021 passed by the District Magistrate, Jehanabad and the Divisional Commissioner, Magadh Division, Gaya, respectively, after disposal of the aforesaid Criminal Appeals, which are pending before the Hon'ble Apex Court. Liberty, so sought, is granted. 3.

The writ petition stands disposed off.
