Petitioner seeks bail in a case registered under Sections 399/402 of Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case. Neither the petitioner has been pprehended at the spot nor any recovery has been made from his possession. Other than his own confessional statement, there is nothing on record connecting him in the instant case.

The learned APP has opposed the prayer for bail. Be that as it may, considering the submissions of learned counsel for the petitioner noticed herein above, prayer

Patna High Court Cr.Misc. No.50609 of 2018(2) dt.19-09-2018 2/2 for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Forbesganj Police Station Case No 89 of 2018 subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
