JUSTICE PARTHA SARTHY ORAL ORDER 25-06-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Complaint Case No. 1740 of 2015 registered for the offence under sections 323, 341, 498A, 379 and 504 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.

As per allegation in the complaint, it is stated that the complainant was abused, beaten up and tortured by the husband and other relatives for non-fulfillment of the demand of motorcycle and a gold chain.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.19139 of 2020(5) dt.25-06-2020 2/2 that the allegations as levelled in the complaint are false and concocted. The petitioner has no criminal antecedent and has remained in custody since 21.08.2019.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with the period in custody, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Complaint Case No. 1740 of 2015 on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., East Muzaffarpur.
