ANJANA MISHRA ORAL ORDER 06-10-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 467/468/ 471 /465/419/420/406/423/120(B)/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the present dispute is out and out a civil dispute emanating out of a loan taken by the informant for which some signatures were given on blank papers. He further submits that subsequently there was some transfer of land betweens the parties which finally led the filing of a Title Suit No. 216 of 2014 befoer the Sub-Judge 1st, Supaul on

Patna High Court Cr.Misc. No.29459 of 2015 (3) dt.06-10-2015 P2/2 15.07.2014 for declaration of a right, title and possession of the land in dispute. It appears that during the mean time, some applications were also made before the Circle Officer for mutation of the lands but objections were filed thereto and, therefore, the mutation application had been dismissed.

Considering the aforementioned fact that there is civil dispute between the parties necessitating the adjudication thereof, let the petitioners abovenamed, in the event of their arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Birpur, Supaul in connection with Raghopur P.S. Case No. 33 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
