This is an application for bail in connection with Paroo P.S.Case No. 163 of 2017 registered for the offences punishable under Section 414 of the Indian Penal Code and 25(1-B)(a) & 26 of the Arms Act.

Allegation against the petitioner is of recovery of one country made pistol from his possession apart from other allegation.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody for more than four months and he is accused in three more cases. Heard learned APP also.

Having heard both sides and considering the facts and

Patna High Court Cr.Misc. No.56196 of 2017 (2) dt.23-11-2017 2/2 circumstances of the case, I am not inclined to grant bail to the petitioner at this stage.

However, once charge has been framed against the petitioner in this case, learned trial court shall release the petitioner on bail to its own satisfaction with an undertaking that he will co-operate in trial and appear on each and every date, otherwise his bail bond shall be cancelled.

With the above observation, this application is disposed of.
