Petitioner apprehends his arrest in connection with Kahalgaon (Shiv Narayanpur) P.S.Case No. 271 of 2012 registered for the offences punishable under Sections 448, 341, 323, 376(2)(g), 504, 34 and 379 of the Indian Penal Code. Allegation against the petitioner is of gang rape and the occurrence is of 2012 and petitioner is named in the FIR. Submission of learned counsel for the petitioner is that the whole prosecution case is false and medical report does not support the same.

Heard learned APP also, who has opposed the prayer for anticipatory bail.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.50351 of 2018 (2) dt.31-08-2018 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner.

This application is, accordingly, dismissed.
