The petitioner seeks bail in a case registered under Sections 414 of the Indian Penal Code as well as Section 391(viii) of Bihar Jail Manual Rules, 2012 and Sections 45(12)/46 of Jail Act, 1894.

Allegation is that while inspection of jail premises, one mobile was recovered from the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.12.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. While inspection of jail premises one mobile is said to have been recovered. The

Patna High Court CR. MISC. No.17956 of 2019(2) dt.03-05-2019 2/2 petitioner has got no concern with the mobile in question. There is no complain in respect of theft of mobile in question. Hence, no offence under Section 414 of I.P.C. is made out in the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. I, Madhubani in connection with Jhanjharpur P.S. case No.171 of 2018.
