Petitioner seeks bail in Kamtaul P.S. Case No. 145/2017, registered for the offences punishable under Sections 341, 323, 147, 149, 148, 354(B), 324, 448 and 504 of the Indian Penal Code. Allegation against petitioner is that he pulled the Sari of informant and assaulted her with fist and slaps. It is further alleged that he assaulted Ramdhuni Raut with Tengari on his head. It has been submitted that petitioner has falsely been implicated in this case due to enmity. Petitioner and Informant are agnates. There is land dispute. All the injuries sustained by the informant's side are simple except the injury caused on the head of Ramdhuni Raut which is grievous in nature.
Patna High Court Cr.Misc. No.51573 of 2018 (2) dt.04-10-2018 2/2 Petitioner has no criminal antecedent. He is in custody since 30.05.2018.
Considering the fact that petitioner assaulted the informant who is lady with fist and slaps, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
Petitioner may renew his prayer for bail after completing six months in custody.
