Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Bochahan P.S. Case No. 339 of 2021, lodged under Sections 272 and 273 of the Indian Penal Code read with Section 30(a) of Bihar Prohibition and Excise Act and Sections 20/22 of N.D.P.S. Act.
As per the prosecution case, total recovery of 2.5 liter liquor and 50 gram Ganja are the subject matter of the present case.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel also submits that from the seizure list, it transpires that the said recovery was made behind the back of the petitioner's house. Learned counsel further submits that antecedent of the

Learned counsel also submits that the name of the petitioner has figured in this case by virtue of a person who was sitting near his house. Learned counsel further submits that charge-sheet has already been filed in the present case. Learned counsel further submits that the petitioner is ready to fulfill all the conditions whosoever shall be imposed upon him.
Learned A.P.P. for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, Muzaffarpur in connection with Bochahan P.S. Case No. 339 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
