This is an application for bail in connection with Desari P.S. Case No. 120 of 2014 registered for the offences punishable under Sections 147, 148, 149, 341, 324, 325 and 302 of the Indian Penal Code.

Allegation against the accused persons, including the petitioner is of assaulting the deceased and causing his death. Further it appears that petitioner was absconding earlier. Submission of learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and co-accused has been granted bail by this Court vide order dated 30.1.2015 passed in Cr.Misc.No. 38277 of 2014 (Annexure-3) and petitioner is suffering from Hepatitis B, which will appear from

Patna High Court Cr.Misc. No.61500 of 2017 (3) dt.11-01-2018 2/2 paragraph-13 of the bail petition and he is in custody since 11.9.2017.

Having heard both sides and in the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Vaishali at Hajipur, in connection with Desari P.S.Case No. 120 of 2014, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner will co-operate in trial and appear in court as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
