In this case, the petitioner is seeking anticipatory bail in connection with Obra P.S. Case No. 02 of 2018, registered for the offence under Section 30(a)/37(a), 37(d)/38(2) of the Bihar Prohibition and Excise Act, 2016. The incident had taken place on 01.01.2018. The police entered into a room where six persons were taking liquor and from their possession the arms have been recovered. For the same incident, two cases have been lodged, one under the Arms Act and another under the Excise Act. The petitioner was arrested and has been granted bail by the Court below in B.P. No.121 of 2018.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.29293 of 2019(2) dt.03-05-2019 2/2 petitioner has already been granted bail with respect to the same incident.

Looking to the aforesaid facts, let the above-named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII-cum- Special Judge (Excise), Aurangabad, in connection with Obra P.S. Case no. 02 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
