JUSTICE ARUN KUMAR ORAL ORDER 29-01-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Pupri PS Case No. 122 of 2017 registered under Section 394 of the IPC. Learned Counsel for the petitioner submits that there is no material against the petitioner except that accused Subham had a telephonic talk with him one day prior to the alleged occurrence, he has not been identified in the TIP and the petitioner had no criminal antecedent except the present case for which a separate case under the Arms Act has been registered in which the petitioner has been enlarged on bail.

Having considered the said facts and circumstances, the petitioner, namely, Maruti Nandan Chaudhary @ Niraj Chaudhary is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Sitamarhi in connection with Pupri PS Case No. 122 of 2017.
