KUMAR ORAL ORDER 26-10-2021 Learned counsel for the petitioners has submitted that during pendency of this application, petitioner no.4, namely, Sachin Singh has already been apprehended, as such, present petition with respect to petitioner no.4, namely, Sachin Singh has become infructuous and, as such, he seeks permission to withdraw this application as against him. Accordingly, this application is dismissed as withdrawn with respect to petitioner no.4, namely, Sachin Singh.

Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147/ 447/ 341/ 323/ 324/ 325/ 307/504/506 of the Indian Penal Code. Informant has alleged that on 25.11.2020 at about 11:00 am, FIR named accused including the petitioners came at his door having rod, talwar, tangi and hasua with intention to kill. Further allegation is that Guddu Singh and Nanhe Singh (petitioner no.3) hold the informant and Lalbabu Singh (petitioner no.1) assaulted him by means of rod causing head injury and injury on left arm. Ramaji Singh assaulted him on back of the head by means of Tangi. Further it is alleged that Guddu Singh assaulted mother of informant by means of talwar on her right hand and Omprakash Singh (petitioner no.2) assaulted by rod on her left hand. Omprakash Singh (petitioner no.
2) assaulted Ravindra Kumar Singh, the younger brother of the informant, by means of rod causing injury on head and Nanhe Singh (petitioner no.3) assaulted him by talwar. Sachin Singh and Vinay Singh (Petitioner no.5) hold Ajit Kumar and Kameshwar Singh assaulted him by tangi causing head injury.

However, learned APP submits that the victims have sustained serious injury.
Considering the facts and circumstances of the case and nature of allegation and injuries, I am not inclined to grant anticipatory bail to the petitioners. Hence, the prayer for bail of the petitioners is hereby dismissed.
