The petitioner seeks bail in connection with Nautan P.S. Case No.219 of 2024 registered for the offence punishable under sections 341, 323, 325, 379, 504 and 34 of the Indian Penal Code. Later on, section 302 of the Indian Penal Code was added.

As per the prosecution case, accusation against the petitioner and others is of assaulting the deceased, who later died of septicemia.

Learned counsel for the petitioner submits that no offence under section 302 of the Indian Penal Code is made out against the petitioner as the deceased had died because of septicemia. He further submits that the petitioner is in

Patna High Court CR. MISC. No.18964 of 2025(2) dt.11-04-2025 2/2 custody since 07.01.2025 having clean antecedent. 5.

Learned counsel for the petitioner has produced a copy of the order dated 08.04.2025 passed by this Court in Criminal Miscellaneous No.19310 of 2025, by which co-accused Akshay Kumar Yadav has been granted bail by this Court.

Considering the aforesaid facts and circumstances of the case, this bail application for regular bail is allowed.

Let the petitioner, above named, be granted bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned court of S.D.J.M., West Champaran, Bettiah, in connection with Nautan P.S. Case No.219 of 2024, subject to the condition that he will cooperate in the trial and will appear through his lawyer or himself on the dates fixed in the trial.
