The petitioner is apprehending his arrest in connection with Hawai Adda P.S.Case No.242 of 2017 registered for offences punishable under Sections 419, 420, 467, 468, 471 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he placed somebody else at his place in the counseling of D.C.E.C. Examination, 2017 for Diploma Certificate.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted and he is a student and he was present in the examination also.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.49075 of 2018 (2) dt.27-08-2018 2/2 circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed.
