The petitioner seeks bail in Chandi P.S. Case No. 267 of 2017 registered under Sections 420, 413, 414/34 of the Indian Penal Code.

As per the prosecution case, on raid a stolen motorcycle is said to have been recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has not stolen the aforesaid motorcycle rather he has purchased the same from Ajay Kumar and had no knowledge of the said motorcycle to be stolen one. The factum of purchasing the said motorcycle by him from Ajay Kumar is also mentioned in the F.I.R. The petitioner has no criminal antecedent. Similarly situated

Patna High Court Cr.Misc. No.54172 of 2017 (02) dt.13-12-2017 - 2 - co-accused Anuj Kumar has been granted bail by a coordinate Bench of this court in Cr. Misc. No.46863 of 2017 vide order dated 17.10.2017. The petitioner has been languishing in custody since 19.08.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Hilsa, Nalanda in connection with Chandi P.S. Case No.267 of 2017.
