The petitioners seek regular bail in connection with Hilsa PS case no. 41 of 2019 registered for the offence punishable under Sections 457, 380, 395 of Indian Penal Code. The allegation is regarding theft having been committed in the house of the informant and the stolen articles are said to have been recovered from the house of the coaccused person namely Rahul Kuamr and the petitioners herein live in the same building in which the said Rahul Kumar is residing.

The learned counsel for the petitioners submits

Patna High Court CR. MISC. No.17177 of 2019(2) dt.02-04-2019 2/2 that the petitioners have nothing to do with the alleged incident and infact, no recovery has been made from them and merely because they stay in the building in which co-accused Rahul Kumar is residing, they have been implicated in the present case. It is further submitted that petitioners are having clean antecedent and they are languishing in custody since 28.01.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.

Accordingly, the abovenamed petitioners are directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Hilsa, Nalanda in connection with Hilsa PS case no. 41 of 2019.
