The petitioners apprehend their arrest in a case under Section 341, 323, 504 and 307/34 of the Indian Penal Code. The informant was constructing his house over his land, the petitioners obstructed and thereafter the petitioners are alleged to have assaulted the informant with stick. There is counter version being Kudra P.S. case No. 79/2015. From the perusal of injury report, annexure-2, it appears that the informant sustained two injuries, one lacerated wound and one contusion and both injuries are opined to be simple in nature.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named
Patna High Court Cr.Misc. No.29154 of 2015 (2) dt.27-07-2015 2/2 petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in Kudra P.S. Case No. 78 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
