JUSTICE ARUN KUMAR ORAL ORDER 09-08-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody seeks bail in Bettiah Muffasil PS Case No. 78 of 2018 registered under Sections 147, 149, 341, 323, 324, 380, 427, 448 and 506 of the IPC.
Accusation is that large number of persons entered into the house of the informant and it is alleged that one Kunti Devi gave a sickle blow over neck of the informant, Raghunath Sah assaulted on the head of Hasbun Nesha by farsa, Dinesh Mahto and Ramayan Mahto caught Safi Alam and after pouring K.Oil set fire on him. Learned Counsel for the petitioner submits that due to previous enmity the petitioner has been implicated in this case, except name of the petitioner being disclosed in the body of the FIR there is no other specific accusation against him, specific accusation is against some other accused persons and the petitioner has no criminal antecedent.
Whereas learned Counsel appearing on behalf of the informant opposed the prayer for bail.
Patna High Court Cr.Misc. No.48946 of 2018 (2) dt.09-08-2018 Having considered the said facts and circumstances, the petitioner, namely, Rameshwar Sah is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM West Champaran at Bettiah in connection with Bettiah Muffasil PS Case No. 78 of 2018.
