JUSTICE BIRENDRA KUMAR ORAL ORDER 03-06-2019 Heard learned counsel for the petitioner as well as learned APP for the State and learned counsel for the informant. Petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 366 of the Indian Penal Code.

Petitioner is relation of the informant and allegation is that he abducted to the daughter of the informant, who was mother of a child aged about 02 years. The F.I.R. was lodged after missing of the daughter of the informant. Submission is that mere suspicion is there. In fact the daughter of the informant married with another boy, which has come in the Police report submitted in connection with Complaint Case No.198 of 2018 filed by the wife of the

Patna High Court CR. MISC. No. 18639 of 2019(4) dt.03-06-2019 2/2 petitioner against the husband of the victim and others in the court of learned F.T.C. Junior Division, Bijnaur, (U.P.). Charge sheet has already been submitted against the petitioner without any substantial material against the petitioner. Learned counsel for the informant opposed the prayer for bail on the ground that there is direct allegation against the petitioner in the F.I.R.

Considering the entire facts of this case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Sitamarhi Police Station Case No.976 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
