JUSTICE SUDHIR SINGH ORAL ORDER 31-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 498A and 323 of the Indian Penal Code and Section 4 of D.P.Act.

The allegation against the petitioner is of assaulting and torturing to the complainant for non fulfillment of additional demand of dowry.

It has been submitted that the petitioner has no criminal antecedent. It is further submitted that the petitioner is ready to keep the complainant as his wife with full dignity and honour. It is also submitted that the petitioner is ready to deposit an amount of Rs. 1500/- (fifteen hundred) per month in the court below,

Patna High Court Cr.Misc. No.31236 of 2015 (2) dt.31-07-2015 2/2 which shall be released in favour of the complainant. On behalf of the State it has been submitted that the petitioner is named in the complaint petition. Considering the aforesaid facts, let the above named petitioner is directed to deposit an amount of Rs. 1500/- (fifteen hundred) per month in the court below, which shall be released in favour of the complainant.

Let, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Biharsharif, Nalanda in connection with Complaint Case No. 1011C/2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
