Petitioner apprehends arrest in a case registered for the offences punishable under Section 379 and other allied sections of the Indian Penal Code and under section 27 of the Arms Act.
Prosecution's case, in brief, is that the petitioner took out Rs.20,000/- from the informant's pocket on the point of a pistol and on protest, the petitioner and other accused persons assaulted him by fists and slaps.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. FIR has been lodged after delay of two days without explanation. Parties are agnate. He submits that the petitioner is in fact a bus driver and one day he had parked the bus in a field in front of informant's market which was protested by him. This incident caused a minor scuffle between the petitioner and the informant. Thereafter, the informant has lodged this false case implicating the petitioner. There is also land dispute between the parties. Nothing incriminating has come against the petitioner during investigation to connect him with the alleged offence. Considering the facts of the case, prayer for anticipatory bail to the petitioner is allowed. Let the petitioner,
Patna High Court CR. MISC. No.16074 of 2020(2) dt.15-07-2020 2/2 named above, in the event of surrender before the Court below, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Hilsa, Nalanda in Tharthari Police Station Case No. 03/2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
