JUSTICE RAJESH KUMAR VERMA ORAL ORDER 03-11-2021 Heard learned counsel for the appellant and learned Special Public Prosecutor for the State. Learned Special P.P. for the State has raised objection with regard to maintainability of the present appeal. He further submits that the impugned order has been passed by the Special POCSO Court i.e. learned A.D.J.-VI -cum- Special Judge, Purnia, therefore, Criminal Miscellaneous application is required to be filed against the impugned order.

In view of the aforesaid, learned counsel for the appellant seeks permission to withdraw this appeal with liberty to file appropriate application in accordance with law.
