This is an application for bail in connection with Jhajha P.S.Case No. 200 of 2017 registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act.

Allegation against the petitioner is of recovery of one country made pistol and two cartridges while police raided the place.

Submission of learned counsel for the petitioner is that there is no such recovery as alleged and he has no criminal antecedent and he is in jail custody for more than three months. Further submission is that petitioner is a student, who has to appear in examination to be held within a month.

Having heard both sides and in view of facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Jamui, in connection with Jhajha P.S.Case No. 200 of 2017, subject to the following conditions : (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date in court, failing which his bail bond shall be cancelled.
