JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-10-2020 Office has pointed out some defects to which learned counsel of the petitioner submits that he could not remove the defects due to present situation of pandemic. However, he undertakes that he will remove the defects when the court starts normal function.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

No doubt, petitioner is in jail custody since 19.09.2019 but the first information report goes to show that he was not only caught on the spot but recovery of looted article as well as firearm was also made from his conscious possession. Considering the aforesaid facts and circumstances as

Patna High Court CR. MISC. No.20835 of 2020(4) dt.20-10-2020 2/2 well as submissions of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Mufassil P.S. Case No. 243 of 2019 stands rejected.

However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
