2. The petitioner seeks bail in connection with Gurpa P.S. Case No. 08 of 2026 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. It is alleged that from a motorcycle, which the petitioner was driving, altogether 200 liters of country made Mahua wine was recovered.
4. Learned counsel appearing for the petitioner submits that the petitioner is in custody since 29.01.2026 and the vehicle does not belong to him and there is non-compliance of Section 103 of BNSS and he is the sole bread earner of his family and he undertakes to cooperate in the trial.
5. Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner.

6. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.04, Gayaji, in connection with Gurpa P.S. Case No. 08 of 2026.
7. It is directed that the petitioner would be represented on each and every date in the trial and on failure on two consecutive dates, the learned court below would be at liberty to cancel his bail bonds. It is further directed that if the petitioner gets himself involved in similar nature of offences, the prosecution would be at liberty to file cancellation of bail before appropriate forum.
