JUSTICE SUDHIR SINGH ORAL ORDER 31-07-2015 The petitioner is apprehending his arrest in connection with Kishanpur Police Station Case No. 11 of 2015 for the offences instituted under Sections 302/201/120B/34 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

Prosecution case, in short, is that on 11.01.2015 F.I.R. named accused persons served wine and committed murder by strangulating the son of the informant.

It has been submitted on behalf of the petitioner that as per the F.I.R. only a suspicion has been raised against the petitioner for committing the murder of the deceased. Subsequently, the informant had admitted before the Court below by filing application that the name of the petitioner has come due to mistake of fact in the present case. On behalf of the State it has been submitted that the

Considering the aforesaid facts and circumstances, it is directed that the petitioner shall be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Kishanpur P.S. Case No. 11 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
