JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioners and the learned APP for the State.
The petitioners seek regular bail in connection with Kuichaikot P.S. Case No. 292 of 2017, instituted for the offences under Sections 272, 273 and 420 of the Indian Penal Code and Sections 30(a) (b) (c) of the Bihar Excise & Prohibition Act, 2016. The allegation is regarding recovery of 315 litres of illicit liquor from a Honda Car and the said car was being driven by the petitioner no. 1 while the petitioner no. 2 was sitting in the said car.
The learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.61615 of 2017 (2) dt.21-12-2017 2/2 said car does not belong to the petitioners and in fact no recovery was effected from the conscious possession of the petitioners. It is submitted that the petitioners have clean antecedent and they are in custody since 25.10.2017.
Considering the nature of accusation, the period of custody already undergone and the fact that the petitioners have got a clean antecedent, I direct the petitioners named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Session Judge-2nd, Gopalganj in connection with Kuichaikot P.S. Case No. 292 of 2017.
