The petitioner is in judicial custody in connection with Bettiah Town P.S. Case No. 705 of 2021 for the offences under sections 376/120B of the Indian Penal Code and Section 8 of the POCSO Act.

The prosecution story in brief is that on 17.12.2021, at 6:30 P.M., the informant gave her 'fardbeyan' before the Bettiah police station that her 12 years minor daughter went to school but did not return till 12:00 P.M. in the noon. It is further alleged that at about 3:30 P.M., when her daughter came home, the

Thereafter, both the accused persons left the victim girl at 'Tikuliya Chowk'. It was alleged that accused Azazul Mian had committed rape with the victim girl in conspiracy with accused Bebi Begum.

Taking into account the nature of allegation that has been attributed to the petitioner herein, this Court is not inclined to grant him the privilege of bail which is accordingly rejected. (Rajiv Roy, J) Ravi/- U T
