The petitioner seeks bail in Gopalganj Town P. S. Case No. 155 of 2018 instituted for the offence under Section(s) 302, 120B/34 Indian Penal Code. Learned counsel for the petitioner has submitted that petitioner is not named in the written report. There is no allegation of specific overt act against this petitioner in the written report. The informant levelled allegation against the owner of the truck, namely, Dhanlal Mahato and Satish Mahato in the murder of her husband raising suspicion that they had altercation with her husband for payment of wages. The petitioner is in custody since 9.4. 2018. The other co- accused with similar allegation has already been granted regular bail by coordinate Bench of this Court by order dated 19.7. 2018 passed in Cr. Misc. no. 42800 of 2018. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Gopalganj, in connection with Gopalganj Town P. S. Case No. 155 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
