JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Bikram P.S. Case No.227 of 2019 registered under Sections 385, 387 and 506 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the fardbeyan of the informant Bhola Kumar, the present case was instituted on 19.07.2019 against one unknown being the owner of Mobile No.8002834119. In course of investigation, the name of the petitioner surfaced in the confessional statement of the co-accused Chunmun Kumar. In fact, the petitioner is accused in four other cases, as detailed in paragraph-3 to this

No.15989 of 2020(2) dt.04-06-2020 2/2 application, due to that reason, the police implicated the petitioner in the present case showing his name in the confessional statement of the co-accused Chunmun Kumar. Further submission is that the petitioner is not the owner of the mobile number, as detailed in the F.I.R, used in demanding the ransom. The petitioner, in the present case, is in custody since 04.10.2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Danapur, District-Patna, in connection with Bikram P.S. Case No.227 of 2019. Out of the two sureties, one must be either parents or the close relative of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
