The petitioner seeks bail in connection with Bhabua P.S. Case no. 584 of 2017 registered under Section 366(A)/34 of the Indian Penal Code.
Accused Kanchan Kumari and Nitu Devi are said to have kidnapped minor daughter of the informant for the purpose of her marriage and took her to the petitioner (Rubi Devi) at Haryana where they forced her to marry with unknown person. It is submitted by learned counsel for the petitioner that the petitioner had not kidnapped the victim. She has no concern with the aforesaid occurrence. As a matter of fact, after
Patna High Court Cr.Misc. No.54493 of 2017 (3) dt.15-12-2017 2/2 knowing about taking away of the victim by the Kanchan Kumari and Nitu Devi she suo motu took the victim to drop her at her house but she was apprehended at bus stand Bhabua along with the victim. Thus, she has not played any role in the aforesaid kidnapping rather had tried to drop her at her house. The petitioner happens to be lady. The petitioner has been languishing in custody since 20.09.2017 and co-accused Nitu Devi has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 24.11.2017 passed in Cr. Misc. no. 55652 of 2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case no. 584 of 2017.
