The petitioner seeks bail in Hathauri P.S. Case No. 118 of 2016 registered under Sections 272, 273 and 290 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition of Liquor and Excise Act, 2016.
Petitioner is said to have concealed 76.400 litres of foreign liquor under the grass in the field and managed to escape seeing the police party.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. The petitioner was not apprehended on the spot. He has no concern with the seized liquor.
Patna High Court Cr.Misc. No.62971 of 2017 (3) dt.24-01-2018 2/2 Though three criminal cases all under Excise Act have been lodged against the petitioner, but he has been enlarged on bail in all the aforesaid cases. He has been languishing in custody since 31.03.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise Act), Muzaffarpur in connection with Hathauri P.S. Case No. 118 of 2016.
