This is a case registered under Sections 392 of the Indian Penal Code and 27 of the Arms Act.
It is submitted by the counsel for the petitioner that the allegation of loot in the FIR is against unknown persons and he has falsely been implicated in this case on the basis of confessional statement of co-accused though no recovery has been made from the petitioner. He submits that in the other cases pending against him which has been disclosed in Para 3 of the bail application, he is on bail. Petitioner is in jail custody since 17.06.2017.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be
Patna High Court Cr.Misc. No.62592 of 2017 (3) dt.07-02-2018 2/2 released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali in Vaishali (Beliar O.P) P.S. Case No. 104 of 2017 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.
(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
