JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-03-2015 Heard learned counsel for the petitioners as well as learned counsel for the State.

In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 384, 353 and 504/34 of the I.P.C.

Allegedly, the petitioners and other F.I.R. named accused persons used to demand Rs. 1,00,000/- from the amount sanctioned for the construction of the school building by causing threats and further they abused the Headmistress. Submission is of false implication due to dirty village politics. As a matter of fact use of inferior quality for construction of the building was the cause giving rise to institute this false case,

No.37473 of 2014 (2) dt.25-03-2015 2/2 but due to intervention of well wisher and common friends the case has been compromised and the compromise petition has been filed in the court below, copy of which has been annexed as Annexure-2 to this petition. Other co-accused have been allowed bail by this Hon'ble Court vide Cr. Misc. No. 50945 of 2013. In the facts and circumstances as stated above, considering that good senses have been prevailed between the parties and further considering the allegation and counter allegation, the petitioners in case of their arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. A.C.J.M. Rosera, Samastipur in Bithan P.S. Case No. 72 of 2013, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
