The petitioner seeks bail in Fulkaha P.S. Case No. 10 of 2022, registered for the offence punishable punishable under Section 30(a)/41(1) of the Bihar Prohibition and Excise Act, 2016.

702 litres of Nepali liquor has been recovered from Scorpio vehicle of which this petitioner was one of the occupants.

It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and he has got has no concern with the seized liquor. Petitioner is in custody since 14.02.2022 having no criminal antecedent, as stated in para 3 of

Patna High Court CR. MISC. No.19112 of 2022(2) dt.26-05-2022 2/2 the petition. Investigation is complete.

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Excise II, Araria in connection with Fulkaha P.S. Case No. 10 of 2022.
