Sanjay, learned senior counsel, who was assisted by Sri Hemant Kumar, learned counsel for the petitioner and Sri Shyam Bihari Singh, learned A.P.P.
The petitioner, who was a P.D.S. dealer and main accused in Shyampur Bhataha P.S. Case No.46 of 2011, G.R. No. 372 of 2011, registered for the offence under Section 406 and 420 of the Indian Penal Code, has prayed for grant of anticipatory bail.
It appears from the record that there is allegation of misappropriation of food grain amount to the tune of Rs. 9 Lakhs and odd.
Learned senior counsel for the petitioner submits that for an allegation committed long back, the present F.I.R. was lodged and learned senior counsel for the petitioner has also
Patna High Court Cr.Misc. No.38176 of 2014 (3) dt.30-03-2015 2/2 referred to order passed in number of writ petitions [C.W.J.C. No. 4063 of 2012 and other analogous cases]. The said writ petition was disposed of on 7.9.2012. On aforesaid grounds he has prayed for grant of anticipatory bail.
Considering the fact that F.I.R. was lodged long back in the year 2011 and considering the amount of misappropriation, I do not find this case fit for extending the privilege of anticipatory bail.
The petition stands dismissed.
