JUSTICE SATYAVRAT VERMA ORAL ORDER 01-11-2022 Learned counsel for the petitioner at the outset submits that name of this petitioner in the offence transpired based on the confessional statement of Md. Salauddin from whose possession the child was recovered. Learned counsel further submits that Md. Salauddin has been granted regular bail by the Court of learned Chief Judicial Magistrate, Sitamarhi and the case of this petitioner is on better footing than Md. Salauddin as the petitioner was not arrested from the spot and his name transpired in the confessional statement as aforesaid. At this stage, learned counsel for the petitioner seeks permission to withdraw this anticipatory bail application. Permission is accorded.

Accordingly, this anticipatory bail application is dismissed as withdrawn in connection with Sitamarhi P.S. Case

Patna High Court CR. MISC. No.20064 of 2022(2) dt.01-11-2022 2/2 No. 378 of 2021 pending in the Court of learned Chief Judicial Magistrate, Sitamarhi/successor Court.

In the event, if the petitioner surrenders on or before 15.11.2022, the learned trial court shall dispose of the case on the same day, keeping in mind that Md. Salauddin was granted regular bail and the petitioner is a person with clean antecedent. (Satyavrat Verma, J) Kundan/- U T
