The petitioner apprehends his arrest in a case registered for the offences punishable under Section 302 and 34 of the Indian Penal Code.
The mother of the informant disclosed that somebody killed the father of the informant by assaulting him. The informant suspected the hands of Dilip Rajbanshi and Ganauri Rajbanshi with whom he got land dispute that they might have killed his father.
It is submitted that the petitioner is not named in the FIR. Even from the perusal of the order of the learned Sessions Judge there appears that the learned Sessions Judge did not refer any tangible material collected against the petitioner. Dilip Rai and Ganauri Rai have already been enlarged on anticipatory bail
Patna High Court Cr.Misc. No.30499 of 2015 (2) dt.29-07-2015 2/2 vide order passed in Cr. Misc. No. 3731 of 2015. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Subir Kumar, the learned Judicial Magistrate 1st Class, Nawada in Sirdalla P.S. Case No. 164 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
