The petitioner seeks bail in Bihar P.S. Case No. 532 of 2017 registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-B)A, 26 and 35 of the Arms Act.

Informant is the police Sub Inspector who in the FIR has stated that while he was on patrolling, on 20.09.2017 received secret information that some criminals have assembled at a particular place to commit some heinous crime and after receiving the said information, informant reached the place and apprehended four persons but two miscreants managed to escape and thereafter they were searched and arms and ammunitions and other articles were recovered from their

It has been submitted on behalf of the petitioner that from the possession of the petitioner only one mobile phone was recovered and no arms and ammunitions were recovered, which is apparent from the seizure list contained at page 21. Petitioner is in custody since 21.09.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S.
