The petitioners apprehend their arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
The prosecution case, in brief, is that on the order of co-accused Hemant Kumar, co-accused Abhay Kumar Thakur @ Shashi fired from his pistol upon the son of informant and when husband of informant came to save his son, co-accused Abhay Kumar Thakur @ Shashi fired upon him also, as a result of which, both i.e. son and husband of informant sustained firearm injuries and they were taken to hospital for treatment, where the son of informant was declared dead.
Patna High Court CR. MISC. No.19595 of 2022(2) dt.31-08-2022 2/2 Petitioners are not named in the F.I.R. and have been made accused only on suspicion. Petitioners are co-villagers. Allegation of firing is against co-accused Abhay Kumar Thakur @ Shashi. In the F.I.R., the informant, who claimed to be eyewitness of the occurrence, has not named these petitioners. However, during course of investigation, petitioners have been made accused in this case. Petitioners have got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Dagaruwa P.S. Case No. 269 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
