JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-03-2018 Pursuant to the order dated 07.10.2015, whereby the bail bonds of the petitioners were cancelled and non-bailable warrant of arrest were issued, petitioner nos. 2, 3 and 4 have been arrested and are in custody.
Learned counsel for the petitioners seeks permission to withdraw the present revision petition so as to enable petitioner nos. 1, 5 and 6 to surrender before the trial court within a period of three weeks from today positively.
In case, petitioner nos. 1, 5 and 6 surrender before the court below and explain to the court the reason for their not appearing before the trial court on some dates, the court below
Patna High Court CR. REV. No.160 of 2016 (3) dt.19-03-2018 2/2 shall, after hearing them, pass necessary order in accordance with law after taking into account that the petitioner nos. 1, 5 and 6 have been contesting the case and only because of noncommunication to them about the relevant date, they could not appear before the trial court.
With the aforesaid observation, the present revision petition is permitted to be withdrawn.
