JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioners, who claim to be persons of clean antecedents and are in custody since 11.01.2020, seek bail in connection with Adapur P. S. Case No. 8 of 2020 dated 10.01.2020 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears that 330.900 litres of Nepali liquor was recovered from 9 bags. The claim of the petitioners is that they have been arrested on mistaken identity. The offender could somehow or the other managed to escape and the petitioners became unwitting suspects in

Considering the period of custody of the petitioners and their clean antecedents, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, East Champaran, Motihari in connection with Adapur P. S. Case No. 8 of 2020.
