JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 18-12-2015 By way of the present application under Section 482 of the Code of Criminal Procedure, the petitioner seeks a direction to be issued to the respondents for release of the following article which have been seized in connection with Phulwaria P.S. Case No. 141 of 2014 registered under Sections 420, 467, 468, 471 of the Indian Penal Code and 7 of the Essential Commodities Act:- (i) Hero Honda Passion Pro bearing registration number BR-09H-05598;

(ii) Samsung Mobile including BSNL Sim having number 9431255705 and Airtel Sim having number 7781048925;

(iii) Seven bundle empty bags;

Patna High Court Cr.Misc. No.33133 of 2015 dt.18-12-2015 2 / 2 (iv) 76 empty bags of different food corporation; (v) 4 bundle of Double Tiger Branch Printed empty bags;

(vi) One Sewing Machine of Revo Company;

(vii) A weighing Digital Machine;

(viii) One 50 K.G. Wat;

(ix) 50 empty bags; and (x) Two Registers.

In view of the fact that a parallel application seeking release of the aforesaid articles is pending before the court of SubDivisional Judicial Magistrate, Begusarai, I am not inclined to entertain the present application.

Accordingly, the application is dismissed.
