JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 165A, 167, 212, 409, 420, 456, 467, 468, 474 and 201 of the Indian Penal Code. It is alleged that the petitioner being the then District Education Officer allowed Sheojee Singh being an Assistant Teacher to withdraw salary to the tune of `6 lakhs in spite of him being not joined the transferred school i.e. High School, Maker. It is submitted by learned counsel for the petitioner that alleged teacher withdrew his due salary legally and validly and now the petitioner has retired from service.

This Court is not inclined to interfere only because the case was instituted in the year 2000.

Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.32187 of 2015 (2) dt.11-08-2015 2/2 regular bail of the petitioner if he surrenders within a period of six weeks keeping in view of that the petitioner is now retired and thrust of accusation is against the teacher who withdrew the amount.

Accordingly, the application is disposed of in connection with Uchaka Goan P.S. Case No. 141 of 2000 pending in the court of learned CJM, Gopalganj.
